Terms of Service
Draft, September 2026
Who these terms are with
Florida SiteCraft is a brand of a business registered in Germany. Mail in the United States goes to our mailing address, Florida Site Craft, 1000 Brickell Ave, Ste 715 PMB 1407, Miami, FL 33131, a mail forwarding address and not a second place of business. In these terms, "we" and "us" mean that business, and "you" means the client.
What we do
We design, write and build a website for your business, publish it, host it, and make changes to it for as long as your agreement runs. The specific package and its scope are set out in writing before work starts, and the prices published on this site at the time you order are the prices that apply.
What we need from you
We need the facts about your business: what you do, where you work, how people should reach you. We need permission to use any photographs, logos or text you send us, and we rely on your word that you hold the rights to them. If you send us something you do not own, that is a problem we cannot see and cannot fix.
We also need answers. A project waiting on information is a project that is not finished, and we will say so rather than let it drift.
Payment
One-time build fees are invoiced when the site goes live, unless agreed otherwise in writing. Monthly fees are invoiced monthly in advance. Invoices are due within 14 days.
If an invoice goes unpaid for 30 days we will write to you before anything happens to the site. We do not take a website offline without telling you first.
Term and cancellation
Minimum terms are stated with each package and start when the site goes live. After the minimum term the agreement continues month to month and either of us can end it with 30 days' notice in writing.
If you end the agreement, you keep the website and the domain. We will provide the files and assist with the transfer to another provider. We do not charge a release fee, and we do not hold a domain to force a renewal.
Who owns what
Your domain is registered in your name from the beginning. Your content, your photographs and your business information remain yours throughout. Once the build fee is paid, the finished website is yours to keep and to take with you.
What stays ours is the underlying craft: the code patterns, the build tooling and the internal components we reuse across projects. You are not buying those and you do not need them; they are how the site gets made, not part of the site you receive.
What we promise, and what we do not
We build to current web standards and to WCAG 2.1 Level AA, and we measure rather than assume. We aim for the site to be available at all times and we fix faults as quickly as we can, which in practice is usually the same day.
We do not promise that your site will never be unreachable, that it will rank in any particular position in any search engine, that it will produce a particular number of enquiries, or that it will make you immune from any legal claim, including claims under the Americans with Disabilities Act. Nobody can promise those things, and a supplier who does is telling you something they cannot know.
Except where the law does not allow it to be limited, our liability under these terms is limited to the amount you have paid us in the twelve months before the claim arose.
Privacy
How we handle the information you give us is set out in our Privacy Notice, which forms part of these terms.
Governing law
These terms are governed by German law, and the courts of Munich, Germany have jurisdiction. This is a point the attorney review will look at, because a Florida client may reasonably prefer a Florida forum, and we would rather that question be settled properly than glossed over here.
Changes to these terms
If we change these terms we will tell you in writing before the change applies to an agreement that is already running. Changes never apply backwards.
